He can disengage the GPS on the phone. They can require you to keep the phone on, but you don't have to answer if you are not oncall. If he is oncall, he should have a pay differential. In Arizona, some workers won a settlement on being paid for oncall hours, if they have to respond to work.

Unfortunately, an employer can pretty much demand an employee to do anything that’s not illegal. The only exception would be if there was an employment agreement signed that specifically outlines duties.

Is it right? I don’t think so. But other than finding another job or risk getting fired, I don’t think there’s a thing you can do about it.

No, because technically he’s not on the clock. That’s the problem with a lot of employers now-a-days. They expect employees to go above & beyond when they’re not obligated to do so. That’s invasion of his privacy IF they’re tracking him even when he’s OFF. If he’s not doing anything pretaining to the job, then there’s no reason to have it on.

yes, they can demand it. And if he says no, they might fire him. Sounds like it's part of the job description. if he doesn't like it, then he should get another job. They don't have the right to track you while you're not on duty.

I’d call DishNetwork’s main number (it’s on their website or your bill) and report this criminal to them.

For future reference, even though the installers are local, all programming and billing comes from Dish Network corporate – NOT THE INSTALLER. The installer can’t (legally) do anything about your programming packages.
